1.1 These General Terms and Conditions (hereinafter "GTC") of Gregor Jasch GmbH (hereinafter "Seller") apply to all contracts for the delivery of goods that a consumer or entrepreneur (hereinafter "Customer") concludes with the Seller regarding the goods presented by the Seller in its online shop. The inclusion of the Customer's own terms and conditions is hereby rejected, unless otherwise agreed.
1.2 These General Terms and Conditions shall apply accordingly to contracts for the supply of digital content, unless expressly stipulated otherwise.
1.3 These Terms and Conditions apply accordingly to contracts for the delivery of tickets, unless expressly stipulated otherwise. These Terms and Conditions govern only the sale of tickets for specific events described in more detail in the seller's product description and not the execution of these events. The execution of the events is governed exclusively by the statutory provisions governing the relationship between the customer and the event organizer, as well as any differing terms and conditions of the event organizer. If the seller is not also the event organizer, they are not liable for the proper execution of the event, for which the respective event organizer is solely responsible.
1.4 For the purposes of these Terms and Conditions, a consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their independent professional activity. For the purposes of these Terms and Conditions, an entrepreneur is a natural or legal person or a partnership with legal capacity that, when entering into a legal transaction, acts in the exercise of their commercial or independent professional activity.
1.5 Digital content within the meaning of these Terms and Conditions is all data not contained on a physical data carrier, which is produced in digital form and provided by the seller under the granting of certain rights of use as specified in these Terms and Conditions.

2.1 The product descriptions contained in the seller's online shop do not constitute binding offers on the part of the seller, but serve to enable the customer to submit a binding offer.
2.2 The customer can submit the offer via the online order form integrated into the seller's online shop. After placing the selected goods in the virtual shopping cart and completing the electronic ordering process, the customer submits a legally binding offer to purchase the goods contained in the shopping cart by clicking the button that completes the order process.
2.3 The seller may accept the customer's offer within five days,
- by sending the customer a written order confirmation or an order confirmation in text form (fax or email), whereby the receipt of the order confirmation by the customer is decisive, or
- by delivering the ordered goods to the customer, whereby the receipt of the goods by the customer is decisive in this respect, or
- by requesting payment from the customer after they have placed their order.
If several of the aforementioned alternatives exist, the contract is concluded at the point in time when one of the aforementioned alternatives first occurs. The period for accepting the offer begins on the day after the offer is sent by the customer and ends at the end of the fifth day following the sending of the offer. If the seller does not accept the customer's offer within the aforementioned period, this is considered a rejection of the offer, with the consequence that the customer is no longer bound by their declaration of intent.
2.4 When selecting a payment method offered by PayPal, payment processing is handled by the payment service provider PayPal (Europe) S.à rl et Cie, SCA, 22-24 Boulevard Royal, L-2449 Luxembourg (hereinafter: "PayPal"), subject to the PayPal Terms of Use, available at https://www.paypal.com/de/webapps/mpp/ua/useragreement-full , or – if the customer does not have a PayPal account – subject to the terms for payments without a PayPal account, available at https://www.paypal.com/de/webapps/mpp/ua/privacywax-full. If the customer pays using a payment method offered by PayPal that can be selected during the online ordering process, the seller hereby declares acceptance of the customer's offer at the moment the customer clicks the button to complete the order process.
2.5 When submitting an offer via the seller's online order form, the contract text is stored by the seller after the conclusion of the contract and sent to the customer in text form (e.g., email, fax, or letter) after the customer has submitted their order. The seller does not make the contract text available in any other way.
2.6 Before submitting a binding order via the seller's online order form, the customer can identify potential input errors by carefully reading the information displayed on the screen. An effective technical aid for better identifying input errors is the browser's zoom function, which enlarges the screen display. The customer can correct their entries during the electronic ordering process using standard keyboard and mouse functions until they click the button to finalize the order.
2.7 The German and English languages are available for concluding the contract.
2.8 Order processing and communication generally take place via email and automated order processing. The customer must ensure that the email address provided for order processing is correct so that emails sent by the seller can be received at that address. In particular, if using spam filters, the customer must ensure that all emails sent by the seller or by third parties commissioned by the seller for order processing can be delivered.
3) Right of withdrawal
3.1 Consumers generally have a right of withdrawal.
3.2 Further information on the right of withdrawal can be found in the seller's cancellation policy.
3.3 The right of withdrawal does not apply to consumers who are not citizens of a Member State of the European Union at the time of conclusion of the contract and whose sole residence and delivery address are outside the European Union at the time of conclusion of the contract.
3.4 According to Section 312g Paragraph 2 No. 9 of the German Civil Code (BGB), unless otherwise agreed, there is no right of withdrawal for contracts for the provision of services related to leisure activities if the contract specifies a particular date or period for performance. Therefore, a right of withdrawal is also excluded for contracts concerning the sale of tickets for leisure events with a fixed date.
4) Prices and payment terms
4.1 Unless otherwise stated in the seller's product description, the prices quoted are total prices inclusive of VAT. Any applicable delivery and shipping costs will be specified separately in the respective product description.
4.2 For deliveries to countries outside the European Union, additional costs may be incurred in individual cases, which are beyond the seller's control and must be borne by the customer. These include, for example, costs for money transfers by credit institutions (e.g., transfer fees, exchange rate fees) or import duties and taxes (e.g., customs duties). Such costs may also be incurred with regard to money transfers even if the delivery is not made to a country outside the European Union, but the customer makes the payment from a country outside the European Union.
4.3 The payment option(s) will be communicated to the customer in the seller's online shop.
4.4 When selecting credit card payment via Stripe, the invoice amount is due immediately upon conclusion of the contract. Payment processing is handled by the payment service provider Stripe Payments Europe Ltd., 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland (hereinafter: "Stripe"). Stripe reserves the right to conduct a credit check and to refuse this payment method in the event of a negative credit assessment.
5) Delivery and shipping conditions
5.1 Unless otherwise agreed, goods will be delivered by mail to the delivery address specified by the customer. The delivery address specified in the seller's order processing system is decisive for the processing of the transaction.
5.2 If delivery of the goods fails for reasons attributable to the customer, the customer shall bear the reasonable costs incurred by the seller as a result. This does not apply to the initial shipping costs if the customer effectively exercises their right of withdrawal. Regarding return shipping costs, the provisions set forth in the seller's cancellation policy apply if the customer effectively exercises their right of withdrawal.
5.3 Self-collection is not possible for logistical reasons.

6) Granting of usage rights for digital content
6.1 Unless otherwise stated in the product description in the seller's online shop, the seller grants the customer a non-exclusive, geographically and temporally unlimited right to use the provided content for private and business purposes.
6.2 The transfer of the content to third parties or the creation of copies for third parties outside the scope of these Terms and Conditions is not permitted unless the seller has agreed to a transfer of the license subject to the contract to the third party.
6.3 The granting of rights only becomes effective once the customer has paid the full amount due under the contract. The seller may provisionally permit the use of the content covered by the contract even before this point. Such provisional permission does not constitute a transfer of rights.
7) Retention of title
If the seller makes advance payment, he retains ownership of the delivered goods until the purchase price owed has been paid in full.
8) Liability for defects (warranty)
8.1 If the purchased item is defective, the provisions of the statutory warranty for defects shall apply.
8.2 If the customer is a consumer, they are requested to report any delivered goods with obvious transport damage to the delivery person and to inform the seller. Failure to do so will not affect their statutory or contractual warranty rights.
9) Applicable Law
All legal relations between the parties shall be governed by the laws of the Republic of Austria, excluding the laws on the international sale of goods. For consumers, this choice of law applies only to the extent that it does not deprive them of the protection afforded by mandatory provisions of the law of the state in which they have their habitual residence.
10) Place of jurisdiction
If the customer is a merchant, a legal entity under public law, or a special fund under public law, and has its registered office in the territory of the Republic of Austria, the exclusive place of jurisdiction for all disputes arising from this contract shall be the seller's place of business. If the customer has its registered office outside the territory of the Republic of Austria, the seller's place of business shall be the exclusive place of jurisdiction for all disputes arising from this contract, provided that the contract or claims arising from the contract can be attributed to the customer's professional or commercial activities. In the aforementioned cases, however, the seller shall in any event be entitled to bring an action before the court at the customer's registered office.
11) Alternative Dispute Resolution
11.1 The EU Commission provides a platform for online dispute resolution at the following link: https://ec.europa.eu/consumers/odr
This platform serves as a point of contact for the out-of-court settlement of disputes arising from online purchase or service contracts involving a consumer.
11.2 The seller is neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

Sie haben das Recht, binnen vierzehn Tagen ohne Angabe von Gründen diesen Vertrag zu widerrufen.
Bei Verträgen zur Lieferung von Waren beträgt die Widerrufsfrist vierzehn Tage ab dem Tag, an dem Sie oder ein von Ihnen benannter Dritter, der nicht der Beförderer ist, die letzte Ware in Besitz genommen haben bzw. hat.
Bei Verträgen zur Lieferung von nicht auf einem körperlichen Datenträger befindlichen Daten, die in digitaler Form hergestellt und bereitgestellt werden (digitale Inhalte) beträgt die Widerrufsfrist vierzehn Tage ab dem Tag des Vertragsabschlusses.
Um Ihr Widerrufsrecht auszuüben, müssen Sie uns (Gregor Jasch GmbH, Rechte Wienzeile 19, 1040 Wien, Österreich, Tel.: +436644421292, E-Mail: willkommen@gregorjasch.com) mittels einer eindeutigen Erklärung (z. B. ein mit der Post versandter Brief oder E-Mail) über Ihren Entschluss, diesen Vertrag zu widerrufen, informieren. Sie können dafür das beigefügte Muster-Widerrufsformular verwenden, das jedoch nicht vorgeschrieben ist.
Zur Wahrung der Widerrufsfrist reicht es aus, dass Sie die Mitteilung über die Ausübung des Widerrufsrechts vor Ablauf der Widerrufsfrist absenden.
Folgen des Widerrufs
Wenn Sie diesen Vertrag widerrufen, haben wir Ihnen alle Zahlungen, die wir von Ihnen erhalten haben, einschließlich der Lieferkosten (mit Ausnahme der zusätzlichen Kosten, die sich daraus ergeben, dass Sie eine andere Art der Lieferung als die von uns angebotene, günstigste Standardlieferung gewählt haben), unverzüglich und spätestens binnen vierzehn Tagen ab dem Tag zurückzuzahlen, an dem die Mitteilung über Ihren Widerruf dieses Vertrags bei uns eingegangen ist. Für diese Rückzahlung verwenden wir dasselbe Zahlungsmittel, das Sie bei der ursprünglichen Transaktion eingesetzt haben, es sei denn, mit Ihnen wurde ausdrücklich etwas anderes vereinbart; in keinem Fall werden Ihnen wegen dieser Rückzahlung Entgelte berechnet.
Bei Verträgen zur Lieferung von Waren können wir die Rückzahlung verweigern, bis wir die Waren wieder zurückerhalten haben oder bis Sie den Nachweis erbracht haben, dass Sie die Waren zurückgesandt haben, je nachdem, welches der frühere Zeitpunkt ist.
Sie haben die Waren unverzüglich und in jedem Fall spätestens binnen vierzehn Tagen ab dem Tag, an dem Sie uns über den Widerruf dieses Vertrags unterrichten, an uns zurückzusenden oder zu übergeben. Die Frist ist gewahrt, wenn Sie die Waren vor Ablauf der Frist von vierzehn Tagen absenden.
Sie tragen die unmittelbaren Kosten der Rücksendung der Waren.
Sie müssen für einen etwaigen Wertverlust der Waren nur aufkommen, wenn dieser Wertverlust auf einen zur Prüfung der Beschaffenheit, Eigenschaften und Funktionsweise der Waren nicht notwendigen Umgang mit ihnen zurückzuführen ist.
Ausschluss bzw. vorzeitiges Erlöschen des Widerrufsrechts
Das Widerrufsrecht besteht nicht bei Verträgen zur Lieferung von Waren, die nicht vorgefertigt sind und für deren Herstellung eine individuelle Auswahl oder Bestimmung durch den Verbraucher maßgeblich ist oder die eindeutig auf die persönlichen Bedürfnisse des Verbrauchers zugeschnitten sind.
Das Widerrufsrecht erlischt vorzeitig bei Verträgen zur Lieferung von Ton- oder Videoaufnahmen oder Computersoftware in einer versiegelten Packung, wenn die Versiegelung nach der Lieferung entfernt wurde.
Das Widerrufsrecht gilt nicht für Verbraucher, die zum Zeitpunkt des Vertragsschlusses keinem Mitgliedstaat der Europäischen Union angehören und deren alleiniger Wohnsitz und Lieferadresse zum Zeitpunkt des Vertragsschlusses außerhalb der Europäischen Union liegen.
Gemäß § 312g Abs. 2 Nr. 9 BGB besteht ein Widerrufsrecht, soweit nichts anderes vereinbart ist, nicht bei Verträgen zur Erbringung von Dienstleistungen im Zusammenhang mit Freizeitbetätigungen, wenn der Vertrag für die Erbringung einen spezifischen Termin oder Zeitraum vorsieht. Danach ist ein Widerrufsrecht auch bei Verträgen ausgeschlossen, die den Verkauf von Tickets für termingebundene Freizeitveranstaltungen zum Gegenstand haben.
Das Widerrufsrecht erlischt vorzeitig bei Verträgen zur Lieferung von digitalen Inhalten, wenn wir mit der Ausführung des Vertrages begonnen haben, nachdem Sie ausdrücklich zugestimmt haben, dass wir mit der Ausführung des Vertrages vor Ablauf der Widerrufsfrist beginnen und Sie uns Ihre Kenntnis davon bestätigt haben, dass Sie durch Ihre Zustimmung mit Beginn der Ausführung des Vertrags Ihr Widerrufsrecht verlieren.
Allgemeine Hinweise zur Rücksendung von Waren
1) Bitte vermeiden Sie Beschädigungen und Verunreinigungen der Ware. Senden Sie die Ware bitte in Originalverpackung mit sämtlichem Zubehör und mit allen Verpackungsbestandteilen an uns zurück. Verwenden Sie ggf. eine schützende Umverpackung. Wenn Sie die Originalverpackung nicht mehr besitzen, sorgen Sie bitte mit einer geeigneten Verpackung für einen ausreichenden Schutz vor Transportschäden.
2) Senden Sie die Ware bitte nicht unfrei an uns zurück.
3) Bitte beachten Sie, dass die vorgenannten Ziffern 1-2 nicht Voraussetzung für die wirksame Ausübung des Widerrufsrechts sind.
